Minnesota Receipt Deadline Challenge

Carson v. Simon

Lawsuit filed by Republican electors for Minnesota challenging the extension of the mail-in ballot receipt deadline agreed to in a previous lawsuit due to the COVID-19 pandemic. The complaint alleges that the extension violates the U.S. Constitution and asks the court to block the Minnesota secretary of state from accepting ballots received after Election Day. The district court denied the plaintiffs’ motion for a preliminary injunction seeking to block the counting of post-Election Day ballots and dismissed the case, holding that the plaintiffs did not have standing to bring the case. The Republican electors appealed to the 8th U.S. Circuit Court of Appeals, which reversed the district court’s ruling that the plaintiffs did not have standing and also blocked the deadline extension from taking effect.
