Michigan Alliance for Retired Americans v. Benson
Lawsuit filed on behalf of the Michigan Alliance for Retired Americans, the Detroit Chapter of the A. Philip Randolph Institute and individual voters challenging Michigan’s vote by mail restrictions, specifically the mail-in ballot receipt deadline, lack of prepaid postage for mail-in ballots and voter assistance/ballot collection ban. The Michigan Court of Claims denied the plaintiffs’ request for injunctive relief regarding the postage requirement, but extended the ballot receipt deadline for the 2020 general election only and enjoined (meaning blocked) the voter assistance/ballot collection ban for the weekend before Election Day (when a clerk is unable to assist a voter). The Michigan Legislature intervened and appealed the case to the Michigan Court of Appeals, which reversed the Court of Claims’ injunctive relief and ruled in favor of the defendants, leaving the vote by mail restrictions in place for the 2020 general election.
