A pro-voting lawsuit challenging Gov. DeSantis’ call for a special session to conduct mid-decade redistricting. 

Background

Two Florida voters filed a petition in the Florida Supreme Court challenging Gov. Ron DeSantis’ (R) call for a special legislative session to conduct mid-decade redistricting at the direction of President Donald Trump. Plaintiffs seek to compel the governor to demonstrate the authority for his proclamation declaring that the state legislature will convene in April 2026 to draw a new congressional map. Plaintiffs argue this exceeds his power as an executive and ask the court to clarify that the proclamation is not enforceable unless and until the legislature passes legislation triggering redistricting within the state.

Why It Matters

Florida will be the fourth GOP-led state to undergo mid-decade redistricting at the behest of Trump with the intent to secure maximum GOP advantage in the 2026 midterm elections. Mid-decade redistricting in the state could secure up to five additional seats for Republicans. Democrat-led states, including California, Virginia, and Maryland, have sought to counteract these gerrymanders through their own redistricting efforts.
