Common Cause et al v. DeSantis et al

A pro-voting lawsuit challenging the Florida legislature’s new gerrymandered congressional map.

Background

Common Cause and other pro-voting organizations filed a lawsuit in state court challenging the Florida legislature’s new gerrymandered congressional map that “diminshes Black and Latino voting strength” and Democratic strongholds aross the state ahead of the 2026 midterms. Plaintiffs assert that the new map violates the state constitution by intentionally favoring the Republican party and disfavoring the Democratic party. The lawsuit seeks to block the new gerrymandered map from going into effect.

Why It Matters

Gov. Ron DeSantis (R) and his staff used “pretextual excuses” to redraw the state’s congressional map in direct violation of the state constitution’s explicit ban on partisan gerrymandering, the lawsuit alleges. The redrawn congressional map is in coordination with President Donald Trump’s broader mid-decade redistricting plan to secure additional Republican congressional seats ahead of the 2026 midterm elections. Texas, North Carolina, and Missouri have also already passed new maps favoring Republicans without approval from voters.
