Trump Admin Intensifies Military Probe Against Democratic Sen. Mark Kelly, Launches Command Investigation

The Trump administration escalated its effort to punish a sitting U.S. senator for protected political speech Monday, formally converting the Pentagon’s review of Sen. Mark Kelly (D-Ariz.) into an official Command Investigation under military law.
The escalation marks a significant shift. While the administration has not filed charges against Kelly, the act of placing a sitting senator under a Command Investigation for speech critical of the president represents a dangerous departure from democratic norms.

A Command Investigation is a formal military fact-finding process ordered by a senior commander to determine whether misconduct occurred and what, if any, action should follow. Unlike the Pentagon’s earlier preliminary review — which was largely an internal legal assessment — a Command Investigation authorizes an investigating officer to gather evidence, conduct interviews under oath and produce official findings and recommendations.
The Pentagon confirmed the move in a statement provided to reporters.
“The Office of the Secretary of War, in conjunction with the Department of War’s Office of the General Counsel, is escalating the preliminary review of Captain Mark Kelly, USN (Ret.), to an official Command Investigation,” a Pentagon official said. “Retired Captain Kelly is currently under investigation for serious allegations of misconduct. Further official comments will be limited to preserve the integrity of the proceedings.”
Kelly, a decorated Navy veteran and twice-elected senator from Arizona, was targeted for his role in a video published Nov. 18 alongside five other Democratic lawmakers. In the video, the group reminded members of the military and intelligence community that they swear an oath to the Constitution — and that under U.S. law they are obligated to refuse unlawful orders.
The video did not name President Donald Trump, issue commands or urge disobedience to lawful authority. It reiterated long-standing military doctrine.
Nevertheless, Trump reacted by branding the lawmakers’ conduct “seditious,” repeatedly calling for their imprisonment and execution. Days later, the Defense Department announced it was reviewing “serious allegations of misconduct” against Kelly alone, citing statutes governing retired service members.
In response, Kelly’s legal team immediately warned that any such move would cross constitutional boundaries.
“To be clear: there is no legitimate basis for any type of proceeding against Senator Kelly, and any such effort would be unconstitutional and an extraordinary abuse of power,” Paul J. Fishman, the attorney representing Kelly, wrote in a letter to the Secretary of the Navy, John Phelan. “If the Executive Branch were to move forward in any forum — criminal, disciplinary, or administrative — we will take all appropriate legal action on Senator Kelly’s behalf to halt the Administration’s unprecedented and dangerous overreach.”
The letter also underscores how far the administration has already gone, noting that the Navy had completed its initial assignment and briefed Defense Secretary Pete Hegseth, and that officials had contemplated recalling Kelly to active duty for possible court-martial proceedings — an extraordinarily rare step, especially more than a decade after Kelly’s retirement.
Kelly said on CNN Monday night that he had not been formally notified of the investigation and only learned about it through social media. He also questioned the premise of the Pentagon’s action, noting his long separation from military service.
“I haven’t heard anything. Social media, that’s how we were notified. That’s how unserious they are,” Kelly said. “I spent 25 years in the United States Navy. I retired from the Navy 14 years ago. I’m not in any command now. I don’t know what they’re talking about.”
Kelly previously denounced the administration’s actions as intimidation and political persecution.
“The Department of Defense is coming after me because they don’t like what I have to say,” Kelly said in a statement earlier in the process. “Let’s call this what it is: Political persecution.”
The FBI has requested interviews with the other lawmakers who appeared in the video. Several have reported waves of threats after Trump’s posts, including death threats and a bomb threat against a district office.
