DSCC v. Erie County Board of Elections
Lawsuit filed by the Democratic Senatorial Campaign Committee (DSCC) and Bob Casey for Senate challenging the Erie County Board of Elections’ decision to not count 98 provisional ballots missing the second required voter signature in the November 2024 general election. The Democratic plaintiffs claim that the otherwise valid provisional ballots were disqualified solely for missing one of two required voter signatures, which was the direct result of inaccurate poll worker instructions and thereby violating voters’ due process rights and the Help America Vote Act. The plaintiffs ask the court to reverse the county board’s decision to disqualify the 98 provisional ballots.
RESULT: On Nov. 22, the court denied the plaintiffs’ request to count the 98 provisional ballots.
