Kansas Democratic Party v. Schwab
Petition filed on behalf of the Kansas Democratic Party, Democratic National Committee, Democratic Senatorial Campaign Committee and Democratic Congressional Campaign Committee seeking to force the Kansas secretary of state to implement an election reform bill, which, among other things, permits out-of-precinct voting and creates a signature mismatch cure process, in time for the 2020 general election after the secretary announced the law would not be implemented. The petitioners later withdrew their petition, but “maintained their request to enjoin the Secretary from attempting to ‘obstruct’ the implementation by local county election officials of” the election reform bill. The secretary’s motion to dismiss was granted by the court for lack of subject matter jurisdiction and the petitioners’ failure to state a claim.
