South Carolina Absentee Voting Restrictions Challenge

Lawsuit filed on behalf of four voters under the age of 65 challenging a South Carolina law that only allows voters to vote absentee if they are over the age of 65 or fall into several limited categories. The voters allege that the law violates the 26th Amendment by denying the right to vote to many voters under 65 who did not fall into specific categories that allow them to vote absentee. 

The plaintiffs also allege that South Carolina’s restriction on who may vote absentee violates the 14th Amendment’s Equal Protection Clause and the First and 14th Amendments’ rights to free speech, association and due process. The plaintiffs request that the court allow all voters under 65 the same right to vote by mail afforded to those over 65.
