Hoffmann v. New York State Independent Redistricting Commission

Petition filed on behalf of New York voters against the New York State Independent Redistricting Commission (IRC) and its members alleging that the IRC failed to complete its mandatory redistricting duties. The petitioners argue that, during the post-2020 census round of map drawing, the IRC failed to submit a second set of congressional and legislative maps to the New York Legislature after its first set of maps were rejected. The Legislature then took over the map-drawing process after the IRC didn’t submit a second round of proposals. (The congressional and state Senate maps were ultimately struck down in state court and replaced with new maps for the 2022 elections.) The petitioners ask the state court to issue a writ of mandamus directing the IRC and its members to “fulfill their constitutional duty” by submitting new map proposals that can be adopted “immediately following the 2022 elections.” On Sept. 12, 2022, the court dismissed the case. On Oct. 17, 2022, the petitioners appealed the court’s dismissal of the lawsuit.

On Thursday, July 13, an appellate state court ordered New York’s Independent Redistricting Commission (IRC) to redraw the state’s congressional map. On July 25, Republican intervenors appealed the July 13 decision. On Sept. 19, New York’s highest court paused the decision ordering the IRC to reconvene as litigation is ongoing.

Oral argument in New York’s highest court was held on Nov. 15, 2023. On Dec. 12, 2023, New York’s highest court affirmed the appellate court decision requiring the IRC to reconvene to draw a new congressional map for 2024.
