Pennsylvania Allegheny County BOE Appeal

Ziccarelli v. Allegheny County Board of Elections

Petition for review filed by Republican state Senate candidate appealing the Allegheny County Board of Elections’ decision to count mail-in ballots containing “undated voter declarations.” The trial court affirmed the BOE’s decision and denied the petition for review, finding that the ballots were sufficient. The candidate immediately petitioned the Pennsylvania Supreme Court for “extraordinary relief,” while also appealing the decision to the state appellate court. The state appellate court reversed the trial court, but the Pennsylvania Supreme Court reversed the appellate court in finding that the challenged ballots were valid.

This case was one of the lawsuits former President Donald Trump and his allies brought in an effort to overturn the results of the 2020 election.
